Bankruptcy law allows a married person to file an individual bankruptcy. However there will be some impact on the non-filing spouse especially if they married couple have joint debt and joint account that depend on financing.

If you are a non-filing spouse, there are some concerns that you should keep in mind, including your credit score, which could be be negatively impacted.

Best approach is to have a professional examine your financial portfolio and outlook and whether you will need to take loans in the near future or not, among other factors that must be examined.
